Updated Presidential Guidance on Vento Bands

The Presidents of the Employment Tribunals in England and Wales and in Scotland have issued a joint Fourth Addendum to the Presidential Guidance on employment tribunal awards for injury to feelings and psychiatric injury (Vento Bands). This is in light of changes to the RPI measure of inflation.

The Addendum has updated the Vento Bands which will apply to such claims presented on or after 6 April 2021. The bands will be as follows:

  • a lower band of £900 to £9,100 (less serious cases);
  • a middle band of £9,100 to £27,400  (cases that do not merit an award in the upper band); and
  • an upper band of £27,400 to £45,600 (the most serious cases), with the most exceptional cases capable of exceeding £45,600.

The Addendum notes that, in respect of claims presented in Scotland, the bands remain subject to paragraph 12 of the Presidential Guidance as originally issued on 5 September 2017: this is that if an Employment Tribunal determines that a 10% uplift does not apply then it should adjust its approach and figures accordingly and set out its reasons for reaching that conclusion.
